I. Introduction & Agreement

Welcome to Make It Fun Racing BV ("Company," "we," "us," "our"). We are a Besloten Vennootschap registered with the Kamer van Koophandel (KVK) in the Netherlands. These Terms and Conditions ("T&C") govern your access to and use of our facilities, website, products, and services.

By purchasing a membership, booking a workshop, using our facilities, or accessing any of our services, you ("User," "Member," "Customer," "you") agree to have read, understood, and be legally bound by these T&C. These T&C apply to all activities conducted at our premises located at the ENCI Mine, Maastricht (the "Venue").

II. Definitions

  • "Company": Refers to Make It Fun Racing BV.

  • "User": Any individual or entity that uses any of the Company's Services, including Members, workshop participants, corporate clients, event attendees, and guests.

  • "Member": A User who has an active, paid monthly membership subscription.

  • "Services": Encompasses all offerings provided by the Company, including but not limited to: access to the RC car track and FPV flying areas, use of workbenches and tools, participation in workshops and events, 3D printing services, corporate team-building packages, retail sales, and equipment rental.

  • "Venue": The Company's physical premises located at the ENCI Mine, Maastricht.

III. Membership & Access

  1. Eligibility: Users must be 18 years of age or older to purchase a membership or book a workshop. Rules regarding minors are detailed in Section V.

  2. Membership: A monthly membership is offered at the price listed on our website (€55 per month, subject to change)1. Membership is activated upon receipt of the first payment.

  3. Auto-Renewal: Memberships are subscription-based and will automatically renew and be billed on a recurring monthly basis to the payment method on file, unless cancelled in accordance with Section VIII.

  4. Non-Transferable: Memberships, workshop bookings, and track passes are non-transferable and may not be shared with or used by any other individual.

IV. Code of Conduct & Safety Rules

User safety is our highest priority. All Users must adhere to the following rules at all times. Failure to comply may result in immediate revocation of access without refund.

  1. General Conduct: All Users shall act in a respectful and responsible manner. Harassment, abuse, discriminatory behaviour, or any action that endangers or disrupts the experience of others is strictly prohibited. Users are responsible for cleaning up their workspace after use.

  2. Safety Compliance: All Users must comply with all posted safety regulations and follow all verbal and written instructions from Company staff.

  3. Equipment Use: Use all tools and equipment only for their intended purpose and in accordance with provided instructions. Any damaged or malfunctioning equipment must be reported to staff immediately.

  4. RC Track & FPV Zone Safety:

    • Adhere to all track/zone-specific rules, including directional traffic for RC cars.

    • Before entering a track area, ensure it is clear to do so.

    • FPV pilots must coordinate frequencies with others to avoid video signal loss or interference.

  5. Workshop & Tool Safety: Users acknowledge that activities may involve sharp tools, chemicals (glues, paints), and hot equipment (soldering irons, 3D printer nozzles). Appropriate safety gear (e.g., safety glasses) must be used where required.

  6. Lithium Polymer (LiPo) Battery Safety: LiPo batteries must be charged, discharged, and stored according to manufacturer specifications and Company policy. All charging must be done within designated fire-resistant charging bags or containers and must be supervised.

  7. Prohibited Activities: The use of Company facilities for any illegal activity, unauthorized commercial services, or storage of hazardous materials is strictly forbidden.

V. Rules for Minors

  1. Supervision: Children under the age of 16 must be accompanied and actively supervised by a parent or legal guardian at all times at the Venue.

  2. Responsibility: The accompanying parent or guardian is solely responsible for the safety and conduct of the minor. By bringing a minor to the Venue, the parent or guardian confirms they have read and agree to these T&C on behalf of the minor and accept full responsibility for the minor's compliance and any damages they may cause.

  3. Workshops for Minors: Specific age requirements may apply to certain workshops, as detailed in the workshop description.

VI. Workshops, Events, and Bookings

  1. Booking and Payment: All workshops, corporate events, and service bookings must be paid in full at the time of reservation to secure your spot.

  2. Cancellation Policy:

    • By User: For workshops and private bookings, cancellations made more than 7 days prior to the scheduled date will receive a full refund. Cancellations made within 7 days but more than 48 hours prior will receive a credit for a future service. Cancellations made within 48 hours of the event, and all no-shows, are non-refundable.

    • By Company: We reserve the right to cancel or reschedule any workshop or event due to low enrollment or unforeseen circumstances. In such cases, affected Users will be offered a full refund or the option to reschedule.

VII. Intellectual Property

  1. Company IP: The Company name, logos, branding, and all proprietary content including workshop curricula and instructional materials are the exclusive intellectual property of Make It Fun Racing BV. 2

  2. User-Generated Designs: You, the User, retain full ownership of the intellectual property rights to your own original designs, computer-aided design (CAD) files, and physical prototypes that you create using the Company’s services (e.g., 3D printing). 3 The Company makes no claim to your IP. You agree that you are solely responsible for ensuring your designs do not infringe upon any third-party patents, trademarks, or copyrights.

VIII. Membership Cancellation and Termination

  1. Cancellation by Member: A Member may cancel their monthly membership at any time by providing a written 30-day notice. The final payment will be charged, and the membership will remain active until the end of the billing cycle following the 30-day notice period. No pro-rated refunds will be issued.

  2. Termination by the Company: The Company reserves the right to terminate or suspend a User's access to its Services, without refund, for any reason, including but not limited to:

    • Serious or repeated violation of these T&C, especially safety rules.

    • Failure to make timely payments.

    • Engaging in illegal, abusive, or dangerous behavior.

IX. Risk, Liability, and Indemnification

  1. Acknowledgement of Inherent Risks: You acknowledge that participation in the Services (including RC racing, FPV drone flying, model building, and using workshop tools) involves known and unanticipated risks. These risks include, but are not limited to, injury from high-speed moving objects, sharp tools, hot surfaces, electronic components, chemical substances, and potential fire hazards associated with LiPo batteries. 4444

  2. Liability Waiver: To the fullest extent permitted by Dutch law, you knowingly and voluntarily assume all risks, both known and unknown, associated with using the Services. You hereby release, waive, and discharge Make It Fun Racing BV, its owners, employees, and agents from any and all liability, claims, demands, or causes of action arising out of any damage, loss, or injury to you or your property while using the Services or present at the Venue.

  3. Indemnification: You agree to indemnify and hold harmless the Company from any and all claims, liabilities, costs, and expenses (including legal fees) arising from your actions, your violation of these T&C, or any injury or damage caused by you or any minor under your supervision.

X. Photography and Media

You acknowledge that the Company may take photographs and videos of activities at the Venue for promotional and marketing purposes. Your presence constitutes consent to be filmed or photographed. If you do not wish to be included, please notify a staff member upon arrival.

XI. General Provisions

  1. Amendments: The Company reserves the right to modify or update these T&C at any time. The "Last Updated" date at the top of this page will be revised. Your continued use of the Services after any changes constitutes acceptance of the new T&C. Major changes will be communicated to Members via email.

  2. Governing Law and Jurisdiction: These T&C shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these T&C shall be subject to the exclusive jurisdiction of the competent courts of Maastricht.

  3. Severability: If any provision of these T&C is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

  4. Entire Agreement: These T&C, together with our Privacy Policy, constitute the entire agreement between the User and the Company, superseding all prior or contemporaneous agreements, representations, and understandings.
